Spousal Open Work Permit : How to Support Your Partner's Employment in Canada
Overview of Eligibility for Spouses and Common-Law Partners of International Students and Temporary Workers
Canada’s temporary residence programs have undergone important changes, now enabling the spouses or common-law partners of international students and temporary workers to apply for an open work permit. This type of work permit allows your partner to work for any employer in Canada, subject to certain exceptions. This policy provides an excellent opportunity for families to remain together while you study or work in Canada, making it easier for both of you to contribute to and benefit from your Canadian experience.
If you are an international student or a temporary foreign worker, your spouse or common-law partner may be eligible for an open work permit, which can significantly improve your immigration journey.
Eligibility for a Spousal Open Work Permit
Eligibility for Spouses/Common-Law Partners of International Students:
Effective April 30, 2024, the following categories of international students will allow their spouse or common-law partner to apply for an open work permit:
International students holding a valid study permit and enrolled in:
Master’s or doctoral degree programs.
Eligible pilot programs.
Specific professional degree programs at recognized universities.
These programs include high-demand fields like medicine, law, engineering, and pharmacy. If you are enrolled in such a program, your spouse or common-law partner may be eligible for an open work permit.
Eligibility for Spouses/Common-Law Partners of Temporary Workers
Spouses or common-law partners of temporary foreign workers may also be eligible for an open work permit, subject to the following conditions:
- You must hold a valid work permit as a temporary foreign worker.
- Your occupation must be eligible for family support, which includes a broad range of industries (excluding specific occupations such as those regularly offering adult services).
- Your work permit must be valid for at least 6 months.
Important Notes :
- Proof of your relationship (e.g., marriage certificate or common-law partnership evidence) will be required.
- In the case of temporary workers, documentation verifying your work status and the duration of your permit will be necessary for your spouse or common-law partner’s application.
Required Documents for the Open Work Permit Application
To successfully apply for a spousal open work permit, your spouse or common-law partner will need to provide the following supporting documentation :
- Proof of your relationship, such as a marriage certificate or evidence of a common-law partnership.
- Proof of enrolment for international students, which may include:
A valid letter of acceptance from a designated learning institution (DLI).
A proof of enrolment letter or official transcripts.
- Proof of work status for temporary workers, including
A copy of the work permit.
Employment verification (such as an employer letter or contract).
Duration of the Open Work Permit
The open work permit for spouses or common-law partners will typically be valid for the same duration as the principal applicant’s study or work permit. This ensures that your partner can stay and work in Canada for as long as you maintain your study or work status.
